Terms of Service

These Terms of Service ("Terms") form an agreement between you and Overlap governing your use of overlaptrip.com and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

• You must be at least 18 years old to create an Overlap account. The Service is not directed at children, and accounts may not be created by or on behalf of anyone under 18.
• You may add children to your travel party profile only as a coarse age range, as their traveling parent/guardian, for the purpose of matching — never as a separate account.
• You're responsible for the accuracy of the information you provide (who's in your party, your trip dates and destinations) and for keeping your login credentials confidential.
• You're responsible for activity that happens under your account. Tell us right away at hello@overlaptrip.com if you suspect unauthorized access.
• One account per household/travel party. Don't create accounts to evade a suspension or ban.

Overlap helps travelers discover other couples, families, and friend groups whose trip dates and destinations overlap with their own, using information you and other users provide. Overlap:

• Does not run criminal background checks, ID verification, or identity verification on users.
• Does not guarantee the accuracy of any user's profile, party composition, or trip details.
• Does not endorse, recommend, or vouch for any user you connect with.
• Is not a substitute for your own judgment about who to meet, where, and how.

You are solely responsible for your interactions with other users, on and off the Service. See our Safety page for guidance before meeting anyone in person.

You agree not to:

• Provide false information about your identity, your travel party, or your trips (including impersonating another person or fabricating trips to harvest others' itineraries).
• Harass, threaten, stalk, or abuse another user, including using trip/date information learned through the Service to locate someone in the physical world without their consent.
• Post content that is unlawful, sexually exploitative of a minor, hateful, or that promotes violence.
• Use the Service to advertise, solicit money, or run a commercial operation without our written permission.
• Scrape, harvest, or bulk-collect data from the Service, or attempt to circumvent rate limits or access controls.
• Attempt to access another user's account, or reverse-engineer, probe, or disrupt the Service's security or infrastructure.

Violating this section may result in content removal, suspension, or a permanent ban, at our discretion, with or without notice for serious violations (e.g., threats or content endangering a child).

You retain ownership of the profile information, photos, bios, and messages you submit ("Content"). By submitting Content, you grant Overlap a limited, non-exclusive license to store, display, and transmit it as necessary to operate the Service — for example, showing your party's profile to a matched traveler, or delivering your message to the person you sent it to. We don't license your Content to third parties for their own use, and we don't sell it.

You're responsible for having the right to post any Content you submit, including photos. Don't upload a photo of someone else without their permission, and don't upload a photo that identifies a child (consistent with the age-range-only approach described in our Privacy Policy).

Messaging unlocks only after both parties in a potential match choose to connect. You can disconnect, block, or report another user at any time; blocking prevents future contact through the Service. Reporting a user for harassment, a fake profile, a scam, or a safety concern (including any concern involving a child) sends the report to our moderation team for review.

We may suspend or terminate your account for violating these Terms, for behavior that risks the safety of other users, or for extended inactivity, at our discretion. You may delete your account at any time from Settings or by emailing us; see our Privacy Policy for what happens to your data after deletion.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT MATCHES WILL BE ACCURATE, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY USER YOU MEET THROUGH THE SERVICE WILL BEHAVE AS THEIR PROFILE SUGGESTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, OVERLAP AND ITS OPERATORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR INTERACTIONS WITH OTHER USERS — ON OR OFF THE SERVICE — INCLUDING IN-PERSON MEETINGS ARRANGED THROUGH OVERLAP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE (WHICH, FOR MOST USERS TODAY, IS $0, AS OVERLAP IS FREE TO USE).

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you have under the law of your own country of residence.

We may update these Terms as the Service evolves. We'll update the date at the top of this page, and for material changes, we'll notify you by email before they take effect.
